These Terms of Service ("Terms") govern your access to and use of https://devbatch.com (the "Site"), operated by DevBatch LLC ("DevBatch," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Engagement work performed by DevBatch is governed by a separate Statement of Work (SOW) and Master Services Agreement (MSA) signed between DevBatch and the customer. Those documents — not these Terms — control the engagement.

1. Use of the Site

You may browse the Site, submit inquiries through our contact form, and otherwise use the Site for lawful, non-commercial information-gathering purposes. You agree not to:

  • Use the Site in any way that violates applicable law
  • Attempt to interfere with or disrupt the Site or its underlying infrastructure
  • Use automated tools to scrape, harvest, or extract data at a rate that materially impacts Site performance
  • Submit false, misleading, or unlawful information through the contact form
  • Reverse-engineer, decompile, or attempt to derive the source code of the Site other than as expressly permitted by law

2. Intellectual property

The Site, including its design, text, graphics, logos, and code, is the property of DevBatch LLC or its licensors and is protected by United States and international intellectual property laws. The DevBatch name and logo are trademarks of DevBatch LLC.

You may view and print pages from the Site for your own personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, or publicly display Site content without our prior written consent.

3. Submissions

When you submit information through the contact form (or by email), you represent that you have the right to share it and grant DevBatch a non-exclusive, royalty-free license to use that information for the purpose of responding to your inquiry and (if applicable) onboarding you as a customer. We will treat your information in accordance with our Privacy Policy.

4. Third-party services and links

The Site may contain links to third-party websites or services that are not owned or controlled by DevBatch. We are not responsible for the content, privacy practices, or availability of those third parties. Your use of any third-party service is governed by that third party's terms.

5. No warranty

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL DEVBATCH LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED USD $100. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.

7. Indemnification

You agree to indemnify and hold harmless DevBatch LLC, its officers, directors, employees, and affiliates from and against any claim, demand, or expense (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your violation of any law, or (c) your violation of any third-party right.

8. Governing law and venue

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to personal jurisdiction and venue in those courts.

9. Changes to the Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of the Site after a change means you accept the updated Terms.

10. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms (together with our Privacy Policy) are the entire agreement between you and DevBatch concerning your use of the Site.
